HOPE RALPH IS STILL ON THE JOB

March 2007, My complaint to the Dept. Of Ed is refused on the grounds that they do not fund any programs or activities at the Hawaii State Public Library System.

Good afternoon Mr. Balmer - It took us a couple of days to track down the funds but our records indicate that the the U.S. Department of Education does provide grant funds to the Hawaii State Public Library. Since the library receives funds, the Office for Civil Rights has jurisdiction concerning discrimination on the basis of race, color and national origin (Title VI of the Civil Rights Act of 1964), sex (Title IX of the Education Amendments of 1972), disability (Section 504 of the Rehabilitation Act of 1973) and age (Age Discrimination Act of 1975).

Per your question below, OCR has jurisdiction when a recipient (School/Library) receives Federal funds from the U.S. Department of Education. Title II of the Americans with Disabilities Act is also enforced by our office over public governmental entities whether they receive Federal funds or not. Compliance with this law is not dependent upon the receipt of Federal funds.

The U.S. Department of Justice enforces Title VII of the Civil Rights Act of 1964, which requires nondiscrimination on the basis of race, color and national origin. Compliance with Title VII is not dependent upon the receipt of Federal funds.
