This letter is in response to the concerns you raised regarding the complaint you filed against the Hawaii State Public Library System (HSPLS), which was received by the Office for Civil Rights (OCR) on January 23, 2007. On February 13, 2007, we notified you by letter that we were administratively closing your complaint because HSPLS is not a recipient of federal funding from the U.S. Department of Education. You have expressed concerns regarding our handling of your complaint. Therefore, we are contacting you to further explain our decision regarding your complaint.

According to your complaint, HSPLS was discriminating against you on the basis of your race, color, and national origin. OCR's legal authority to investigate complaints alleging discrimination based on race, color, and national origin is derived from the regulations implementing title VI of the Civil Rights Act of 1964. Under Title VI, however, our jurisdictional authority to investigate complaints is limited to programs and activities that receive funding from the U.S. Department of Education. As we informed you in our February 13 letter, HSPLS is not a recipient of federal funding from the Department. Therefore, OCR does not have the authority to take any action with respect to your complaint or any complaint alleging race discrimination against HSPLS.

Wooten said the UH-Hilo athletic department finished the 2006-07 fiscal year with a $180,000 surplus.

Wooten said various factors played a role in the 2008 deficit, including the closings of Aloha Airlines and ATA, which limited options for team travel — a major expense for every athletic department.

Wooten also said the school added three new sports during McNally's tenure.

Wooten said McNally asked for additional money from the school to start up the new men's sport and was denied, thus leading McNally to believe that the Title IX funds were expected to cover all three new sports.

The suit alleges that Kakugawa-Leong linked the budget deficit to McNally's termination and made other "false claims" in press releases.

I have experienced similar discrimination and conflict of interest within the HCRC. I had submitted 1400 pages of email documents evidencing retaliation at the Hawaii DOE and asked repeatedly for them to subpoena additional prima facie evidence from the DOE. This the investigator failed to do. I have appealed their recommendation of closure with no cause -- for heaven's sake -- I was threatened numerous times verbally and estranged family members were contacted and given my address to write me for some nebulous reason to have me telephone them. Additionally, 500 pages of the 1400 pages I submitted to the HCRC was stolen in the US mail when I had it delivered to a friend who then delivered it to a Hawaii process server. AFter the threats, I feared for my life and left Hawaii -- due to who had threatened me. These Hawaiian KKK have their own little torture methods AND pay off in one way or another the officials they chose to.

Report Says Hawaii Fails to Keep New Teachers

HONOLULU -- A national look at teacher quality gives Hawaii bad marks for not supporting new teachers or retaining good ones, according to the Honolulu Star-Bulletin.

The State Teacher Policy Yearbook said most states do a poor job evaluating and keeping good teachers.


About 2,900 public-school teachers in Hawaii are not considered qualified by the federal government, according to a private consultant.

That means about 22 percent of the state's 13,000 public-school teachers do not qualify under the No Child Left Behind law

School discrimination probe results in deal


The investigation by the Office for Civil Rights of the U.S. Department of E ducation was not a lawsuit and did not involve a money settlement. Instead, the state Department of Education agreed to carry out 26 corrective actions.

The girl was afraid to report the attack because school policy was to suspend anyone in a fight, without regard to who was the attacker and who was the victim.
